Estate Papers, 1918-1928
- Scope and content:
The estate files comprise a highly complex part of the collection due to two factors. One involves the complexity of the estate itself and the amount of litigation that was required to settle it. A second factor involves the various problems the Avellanals had with trustees and attorneys; this too required a great deal of court proceedings to settle. Estate correspondence provides background reading into the nature of the problems Concepcion Avellanal faced--both with attorneys and trustees, as well as with the former associates of Dr. Avellanal. Documents include Dr. Avellanal's will and petition to file the will in probate. Other documents include court actions involving the appointment of Citizens Bank & Trust as executor, removal of same, suits against Newsome (Citizens Bank's liquidator), claims against the Avellanal Estate, claim releases from estate claimants, and the appointment and removal of administrators, trustees, and receivers. The correspondence and litigation files show that, throughout the decade after Avellanal's death, his heirs were involved in a great deal of complex lawsuits and intrigues--both with former associates of Avellanal and with their own attorneys and trustees.
